TERMS OF SERVICE & SERVICE POLICY

These Terms of Use and Service Policy (hereinafter "Terms") govern access to the Atelier du Cristal website as well as all related services offered by Atelier du Cristal ("we", "our", "us").

By accessing our site or placing an order, you ("you", "your") acknowledge having read, understood and accepted without reservation the entirety of these Terms.

If you do not accept these Terms, you must immediately stop using the site.

Purpose of the site

The Atelier du Cristal site offers:

custom sculpture lamps made of epoxy resin and solid wood;
various associated personalization elements (embedded figurine, serial number engraved by hand on the edge of the wood, edition certificate, gift box);
digital content that may accompany the use of the product.

The information, visuals, texts and mentions appearing on the site are provided for information purposes and may be modified at any time without notice.

Eligibility

Use of the site is reserved for persons legally capable of entering into a contract.

Any use of the site implies that the user is of legal age and legally authorized.

Nature of the products — No guarantee of aesthetic or emotional result

The products sold are personalized decorative creations with emotional and sentimental value.

They do not constitute medical devices or health products.

No result is guaranteed (emotional reaction of the recipient, aesthetic perception, surprise effect, etc.). Any experience is subjective and varies between individuals.

Orders and payment

Any order is firm and final once payment is validated.

No modification, cancellation or refund can be claimed after validation, except in cases expressly provided for in our Returns & Refunds Policy.

Payment is made through the secure providers offered on the site. We do not store any banking data.

We reserve the right to refuse or cancel any order for any legitimate reason, in particular in case of suspicion of fraud, inconsistencies, use of anonymization tools or abusive behavior.

Performance of services — Main product: the custom sculpture lamp

The customer acknowledges that the Atelier du Cristal custom sculpture lamp is the main element of the order.

As soon as payment is validated:

the order is automatically transmitted to the workshop for preparation and personalization,
the order is deemed accepted in full.

Even if the customer claims:

– not to have received an email, – not to have consulted their spam folder, – to have made an email address error, – not to have received the physical parcel in the end,

the order remains valid.

No dispute or compensation can be claimed once payment is validated and the order has entered preparation.

Personalization elements (engraved numbering, embedded figurine, gift box)

The personalization elements being products:

made to the customer's order (serial number engraved by hand on the edge of the wood),
clearly personalized and therefore unsellable to a third party,
excluded from the right of withdrawal under consumer protection law applicable to goods made to consumer specifications,

they are not taken back, exchanged or refunded.

The applicable conditions also appear in our Returns & Refunds Policy.

The customer is responsible for their handling, display, preservation and proper use.

Delivery and risk

Delivery times are indicative and may vary according to the carrier.

Delays, blockages, incidents or hazards cannot give rise to any refund, cancellation or compensation.

Upon confirmation of payment, the customer assumes the entire risk concerning the transport of the parcel.

When the carrier indicates that the parcel is "delivered", the order is considered fulfilled.

It is up to the customer to check:

– the neighborhood, – the mailbox, – concierge / reception, – the post office, – pickup point, – usual drop-off location.

No dispute can be accepted if the customer claims not to have received the parcel while tracking indicates "delivered".

User behavior

The user agrees to:

– provide accurate information, – use the site in accordance with the law, – not disrupt the operation of the site, – not exercise abusive, aggressive or threatening behavior towards Atelier du Cristal.

Any violation of these rules may result in immediate suspension of all interaction, without compensation.

Fraud suspicion or attempt

Any order may be suspended, delayed, canceled or refused in case of indications suggesting fraud, such as:

– fraudulent use of a payment method, – inconsistencies in the information, – abusive disputes, – use of VPNs or proxies, – suspicious behavior.

Supporting documents may be required. Without response or in case of insufficient elements, the order may be canceled.

No refund may be claimed before the verifications are closed. No compensation will be granted.

Limitation of liability

Atelier du Cristal cannot be held responsible for:

– direct or indirect damages related to the use of the product or the site, – inappropriate USB-C power connection or inappropriate installation of the lamp, – falls, breakage or mishandling, – alteration related to prolonged exposure to sunlight, humidity or liquid, – absence of subjective aesthetic or emotional result, – delivery delays, – incorrect address, – non-collection of the parcel, – force majeure (strikes, disasters, pandemics, etc.).

Our liability is strictly limited to the amount of the order, excluding shipping costs.

Intellectual property

All content on the site (visuals, texts, videos, logos, files, instructions, etc.) is protected by intellectual property law.

Any reproduction, distribution or use without authorization is strictly prohibited.

Suspension and termination

We may suspend or terminate access to the site or refuse an order in case of non-compliance with these Terms, abusive behavior or suspicion of fraud.

No compensation will be granted.

Personal data

Personal data is processed in accordance with our Privacy Policy.

Modification of the Terms

Atelier du Cristal reserves the right to modify these Terms at any time.

The applicable version is the one in force at the time of the order.

Applicable law

These Terms are governed by the law applicable to the seller's place of establishment.

Any dispute will be submitted to the competent jurisdiction.
